But, it doesn't have a screenshot of Jacob Marshall making that claim. All it has is Ngo's recounting of the claim, which could be ruled hearsay.
For a defense attorney to enter this into evidence, he will have to first depose Marshall and confront him with the claim and get confirmation under oath.
Then, he MIGHT be able to confront Grosskreutz with Marshall's statement during cross-examination, if the judge allows it.
GrossCrouton is going to be deposed for tens of hours over this.
There's a very high likelihood he's going to let slip that it was premeditated. "Premeditated" means he "went looking" for the "supposed shooter" while armed and hoping to "stop him".
Anything like that is going to be incriminating because individuals are not allowed to go hunt anyone with lethal force. That's murder. Even if the person killed someone else.
