You can see in the video, when he's first shot he drops the pistol, and it's sliding on the ground. So in that photo, he's retrieved it and is holding it and his finger is now on the trigger.
I think, otherwise how else did it get back into his hand? Could be wrong.
Look closely, he was holding his cell phone in his left hand and dropped it when he was shot. That's what you see sliding on the ground, he never lost his grip on the weapon. Whether he could still use it or not is another question.
Supposedly bicep dude was live streaming at the time it took place, there was a post here last night linking to it. I can't vouch for the authenticity of it but it sure looks genuine. He actually asks Kyle what's going on, Kyle says he's going to the police, and then it's the mob chasing after Kyle. The picture goes dark when he drops the phone and you can hear him screaming for a medic.
