Incumbents always seem to get away with defamation though, something to do with having immunity for statements made while inside capitol hill or some shit? Not super familiar with what they use to give them selves immunity, but they use it often it seems.
It is in the constitution, Article 1. Can't recall verbatim atm, but it deals with members of Congress not being arrested for what they say while in Congress. Which normal people interpret as in the halls of Congress, whereas Swallowswell types interpret as anywhere as long as they technically hold office.
Seems like an article that was written with the intention to protect those who challenged the incumbent on particular actions, policies or directions of the country -- that this then couldn't be used against them for charges of sedition, treason, ect.
But has morphed, as you say into an article that protects members from any liability from things they verbal say while in office.
Seems term limits are a good remedy to this issue too, while still allowing a pure interpretation of it's written word.
