His extradition hearing is set for Sept. 25, during that hearing WI will have to answer to the Illinois court why they have standing to have Kyle handed over to them.
If all they have is what is in the current filed criminal affidavit there is a goosd chance the judge will deny extradition.
People don't quite understand how the US works anymore, I blame it on the failure of civics.
The reason we have extradition hearings is because each state is actually its own country technically, we are a federation of states. If a state wants a citizen from another state the requesting state has to prove in court that there is sufficient evidence that the defendant committed a crime in the requesting state.
Usually these hearings are rubber stamped, but this one will not be like that. Kyles lawyers will argue that Kyle acted in a lawful manner and is being wrongfully prosecuted.
It's a slim chance, but the evidence is very much in Kyles favor, the judge may very well say, fuck no WI you may not have our citizen for your kangaroo court.
Just keep in mind that you need to check to see if your permits are valid in WI. Don't get arrested.
