It's a licensing deal. Spotify pays Rogan a fee to put his content on their service. It is completely up to Spotify on which episodes they wish to "purchase". This is like getting mad at HBO because blockbuster doesn't have all their TV shows available for rental.
With that being said, assuming Joe Rogan surrounds himself with competent people, he should have saw this one coming. Curious to see what he'll have to say considering he allegedly made the move in the name of censorship after being told he couldn't have Alex Jones on again. Spotify simply not purchasing the episodes is just as bad.
Rogan (or his attorneys) are sophisticated media people, they could have easily demanded that the Spotify contract require that ALL the episodes be posted, or none of them could be.
