They won't just claim it, several states have enacted 'national popular vote' type legislation indicating that their electoral votes will go to the winner of the national popular vote instead of the results of their state elections. This will of course be challenge in court as disenfranchising voters of that state, but that's the idea to tie it up in a long legal process and muddy the waters.
