Could a legal-pede opine whether or not the felony murder rule would apply in the Rittenhouse case? Would an honest prosecutor not charge Kyle but instead charge the attackers under the felony murder rule?
If you're talking about repeat offender or known gang status, no. Unless of course there's a willing DA that will put forth charges against Lefty, because the other 2 fuckturds are cold af.
The "felony Murder Rule" I am thinking about is the one where, for example, if two guys break into a home and one is killed by the homeowner the surviving accomplice is charged with murder because someone died as a result of the felony.
I'm having a difficult time applying that to this situation. I now see where you're going. The problem I have is did they explicitly gang up to attack Kyle. I don't see either of the 3 goofs as being tightly knit. I do see then more as a mob mentality. If there's proof all 3 attacked in unison, then yeah, Lefty the survivor has a problem.
Shouldn't Biceps Boi be charged? He was assaulting a man with a gun.
He should be. Unfortunately, he likely won't be charged because the DA is under pressure to not start more shit.
No because it was too hectic of a situation and the people acted in good faith. If I were a prosecutor I'd walk away from it as the main instigators are gone and kyle is innocent.
