With Twitter locking down accounts, you will need to produce convincing evidence (which may no longer be publicly available) and convince 12 people (I assume it will be a civil case and not criminal) of how the technology works, and Jack's company is harassing a specific class of users on the platform.

Didn't know what language the backend was written in. Figured they are using cloud server or serverless for backend execution. Conceptually, what they are doing is not extremely difficult. NoSQL for storage, trending algorithms, search functionality. Not seeing that Twitter is a big tech breakthrough. Given enough budget it can be recreated rather easily. Still doubt much is patentable.

You could "copy" Twitter with team of a few developers who know how to do cloud scale apps. Frankly there are even open source Twitter clones as well. Unless you have their brand and influence on your platform, you won't replace them. You'd need Kylie Jenner and a few hundred other twitteratti to go to your platform. There are a LOT of tech companies that are worth a TON of $$$ due to their user base while their product technically is a pile of garbage.

That wouldn’t be fair from an intellectual property stand point.

However as a platform they should not have liability for users content. By enforcing zero liability, they can be stopped from removing content, banning users etc. If someone has an issue with content on the platform they take it up with the person making the post, not twitter. Zero liability for the platform, and in return no censorship and no bullshit “violates our content guidelines”.

1A is the 'public square' argument, which won in Marsh vs. Alabama. A company-owned town threw Mrs. Marsh off their streets because she went round handing out religious tracts. "huhuhuh, their streets their rules, nobody owes you a platform" go the shitlibs and lolberts. Not so, said SCOTUS.

The court weighed the rights of property owners against that of freedom of speech- they can clash, and it was viewed as shades of grey- the more 'open' a property was, the more weight was given to concerns of public freedom. It's hard to think of a property more 'open', for the purposes of the First Amendment, than Twitter.

Wikipedia as always gives an insight into the minds of leftists, and their rebuttal to treating social media as the 'public square' is the recent case of MCAC vs. Halleck, where a guy who got banned off public access TV for some edgy humour sued on 1A grounds. Courts have ruled fairly consistently that TV isn't a public forum (and you can see why, intuitively- there's only one voice speaking at any one time, and open discussion is inherently impossible), and Halleck lost as TV wasn't something that was traditionally in the remit of the government, and MCAC was a private organisation.

That 'traditional remit' opinion seems usable for us, if a bit flimsy, IMO. Marsh v. Alabama referred to the public square, but with the march of technology that public square is right on our smartphones- indeed, that's how it was all originally sold to us. Twitter and facebook serve much the same purpose as the village square.

Kavanaugh referred to privately-owned public forums such as a comedy club- they weren't bound by 1A as they had a specific purpose (not in the state's remit to provide entertainment). However, where the stated purpose of the organisation is to literally be the town square or however they put it long ago, and twitter was proudly used by the rebels in the Arab Spring, and continuously as a platform for politicians and associated debate, I think it's a reasonable reading to say that yes, social media is indeed within the traditional remit of the government, which would not tolerate wealthy men banishing fractious peasants, wouldn't tolerate Gulf Corp silencing Grace Marsh, and shouldn't tolerate Silicon Valley grotesques technologically unpersoning conservatives.

As an interesting note, there's also the more recent Packingham vs North Carolina in 2017 (link below.)

In short, Packingham was a pedophile that used social media to target his underage victim. When he got out of prison he was ordered to never use social media because he was a known sex predator and that was his MO (sort of like how sex predators aren't allowed to live near schools.)

Well, the 1st Amendment guarantees freedom of association. Packingham's attorney argued that since social media sites are the modern nexus of communication - you can buy a car, rent an apartment, get a job, talk to the power company, address your local politician, etc - that not allowing the sex predator to get on social media violated his ability to associate and interact with people. SCOTUS agreed.

Think about it - child sex predators are allowed on FB and Twatter, but not conservative opinions.

Bringing down Twitter is going to need to be a multi-pronged approach.

  • A single lawsuit is not going to do it, but it is a start. Look for Lin to turn this into a class action suit.

  • Keep pushing for the FCC to reinterpret Section 230 of the 1996 Communications Decency Act.

  • Foment distrust in Jack Dorsey as CEO within the BoD. Question his competency. Challenge his decisions.

  • Put pressure on advertisers. Does Twitter really provide a good return on investment on advertising dollars?

You forget about discovery and depositions. Make Twitter produce the evidence for you. With their recent hack showing the fact that they have blacklisting tools (despite lying and saying they did not), there is likely plenty of evidence that a plaintiff with deep pockets could uncover.

That is where discovery comes in. If Twitter refuses to hand over evidence and that comes out during the trial, then the jury will be instructed to assume the worst that the evidence would have provided.

Also, if Kyle is acquitted then it is no longer a viable defense to say that it was glorifying violence. Then you have the various funds for actual criminals like Jacob Blake that is being passed around on Twitter. The same logic applies to him since he was being arrested on a felony sexual assault warrant.

The way i explain my stance to people is we don't give anorexic women gastric bypass surgery and weight loss pills as treatment.
