The sex act is still illegal....the bill only addresses whether or not the offending party has to be automatically placed on a sex offender list. The law currently states that same sex offenders in this instance are automatically placed on the register, but opposite sex offenders are not. Why?
That said, don't do sex with kids....ever. The age of consent in California is 18 for EVERYONE.

The wiggle room you are talking about is already in place in the laws of many states. It is often refereed to as a "Romeo and Juliet" law. Romeo was older than Juliet. It's meant to protect high school seniors who fuck freshman. Often the age gap can be no more than say 3 years.
This basically extends that gap to a full decade. It's the slippery slope + moving the goal posts. Very scary.

15 y.o. is the limit for judicial discretion and technically, the law pertains to the type of sex being performed. Before, anal and oral sex were listed as requiring mandatory registry... now, its anything goes. So again, a 25 y.o. man can take on a 15 y.o girlfriend (or boyfriend) and even though that is a crime... it may not force them to register as a sex offender - based on the California Judge's discretion.

This law doesn't affect any age of consent laws or age related issues for crimes. It concerns the sentencing process of someone already convicted of a sex crime against a minor.
Summery is that it allows any adult who's had sex with a minor as young as 15 to be given to the judges discretion weather or not they go on the "sex offender" list. They acknowledge that even though this is breaking the law... (ie, sex with a minor) it's important to apply the same standards to homosexuals that were applied to those who were engaging in (traditional)vaginal sex.
