That's not the way it works for libel/slander though. The DA will be very unlikely to see any sanction other than at the ballot box (so probably not) but charging a person does not give others carte blanche to defame them. This is why the word "allegedly" is used so often.

I think you would be right in a world without dirty commies, some of whom wear black robes or sit on juries.
