I've read the mace thing is a lie. He shot the canister Jay had on him thus the cloud. He didn't had the time to get to the mace.
The use of force escalation is NOT what's at issue. If someone attacks you with a chemical irritant, and you are armed, you are well within your rights to shoot until the threat is no longer active.
Where double aids Michael Stipe's defense falls apart is when you factor in the fact that he was clearly the aggressor in the situation. You can't instigate a confrontation, then shoot someone when they defend themselves with reasonable force. He was the aggressor in the situation and would have been convicted of murder had he lived long enough to make it to court.
If I was carrying and someone was trying to mace me, shooting them is a viable option, the mace is meant to blind me, so they can rob murder or assault me.

The guy who fired the taser at police and was shot, he was shot while using a similar "non-lethal" form of control which we can determine would have possibly incapacitated the police officer leaving him open for bodily harm.
If a police officer was maced, would he have the same justification for self-defense based on that logic?
