According to another comment, they can't charge him with 1st because it happened off camera, so they can't prove that he literally just walked out and murdered him. The defense could argue that they got into a verbal altercation off camera or something stupid like that.
I don't buy that argument. Murder will often be proven by circumstantial evidence. Besides, they have the camera footage showing him waiting inside that parking garage.
