The reason is because there is no evidence to arrest Gaige. Weather you believe they’re lying or not every eye-witness SAYS Gaige pulled out the firearm AFTER Kyle fired and there is no evidence otherwise.
As far as possession of a firearm by a felon, 9/10 that’s a secondary or time of arrest charge. Gaige was never arrested with a firearm. It does happen, but is rare. For example, if you were to post a picture on the Donald with a firearm and we knew you were a felon, chances are slim we’d come and arrest you.
