Some elements of your post ("Detectivedan2") are rather bizarre, however. Kyle quite clearly did attempt to turn himself in to the police, and they rebuffed him. Of course prosecutors will try to avoid any recognition of that, and defense will make the most of it. The jury will have to decide. Your preemptively taking sides against Kyle is kind of weird.
As far as why Gaige wasn't arrested, I think you've stated the "nice" version of that, which is that a firearm possession offense is typically only indicted incidentally to another arrest. The not so nice way to say it is that the law isn't applied consistently, and thus this is available for the department to use against a political persona not grata.
