If Durham secretly indicted someone it won't be announced until after the election, so the American people (at least the ones who aren't paying close attention) won't have the information that the Obama/Biden administration were total crooks before casting their vote. If Biden wins, these indictments will be swept away as soon as he's sworn in, and the media will cheer it.
Exclusions to the rule are traditionally "the prosecution of election-related crimes, such as those involving federal and state campaign finance laws, federal patronage laws, and corruption of the election process" (taken from a Holder memo in case any Dems whine) so the 60-day rule doesn't necessarily apply if the crimes fall under those categories
