"lets you opt-in" is very different from "is forcing". They would be liable to lawsuit if they forced tracking onto their customers.

A user needs system upgrade to 13.7 for latest security updates, which include tracing app. What if a user only wanted the latest security updates but not the tracing app? Will the system “lets you opt-out” when 13.7 is installed?
