What makes you think SCOTUS won't rule the same way? The Constitution is pretty clear that "the whole number of persons in each State, excluding Indians not taxed" are to be counted. Section 2 of the 14th Amendment

In this case it's because Article I Section 2 requires a census and Section 2 of the 14th amendment clarifies that to mean "counting the whole number of persons in each State, excluding Indians not taxed.” (this rule supercedes the 3/5ths rule that existed before the abolition of slavery.)
