I'll play devils advocate here.

No, because our politicians should be trusted to follow the constitution and having politically biased judges stop an order for weeks that might save lives or the country is a dangerous power. What should happen, is that they should be implemented and reviewed at the same time and if found unconstitutional the people who passed / ordered / voted for it should be charged with violating their oaths of office.

Unfortunately that would require politicians that actually understand and want to uphold the constitution, an electorate smart enough to vote them in, and a law system that held our upper class responsible for well, anything.

If unconstitutional emergency powers led to removal from office we wouldn’t have to worry about it, but considering what the democrats have been doing I’m not sure there’s anything they could do that would result in removal.
