I know for a fact that mandates are not laws and no one can force you to wear a mask. I did tell the cross eyed clerk to go fuck himself and flipped him off before leaving so I dont know if that would hurt my case. lol

Not a winnable case. Businesses have the right to refuse service.
Unless you're a Christian bakery refusing to bake a gay wedding cake.
man, the amount of defeatists on here is pretty concerning. i think ill talk to a lawyer first.
It wasn’t until Facebook/Twitter/Reddit/Google started censoring conservative voices that the left started championing the right of a business to refuse service.
I would like to see id this is a legal way to win. Can we get a lawyer pede to weigh in?
According to the Ada's website, unless you can prove that shit with a doctor in court.... then no
Doctors aren't hard to find. Injury lawyers have them on the payroll.
If it quacks like a doc
Shoot. I was really hoping we normalbpeople would have a way to push back against this mack bullshit
we just may. whats the worst that could happen? it gets thrown out of court? ...ok lawsuit lawyers are free
Haha it's so cute people think we live in a place of freedom and anyone outside a millionaire can afford to sue...
lawsuit layers are free, they take a % of the pay out
This isn’t socialism. No lawyer is “free.” The 30-40% win fee attorneys don’t take bad cases.
Unless you find some desperate rookie startup, where your time is as wasted as theirs.
If they don’t see a path to a mediated settlement at least, you won’t even get a phone call after emailing them details of your case.
Not a whole lot we can do. I had people start shit with me when we first had a mandate, and nobody told me. No signs, no nothing, but people knew for days because of Insta.
That's only going to work if you can then prove from a doctor in court that you actually have a medical condition that prohibits you from wearing a mask....
The only power you have is to try to bluff them, but you certainly can't go to court and expect to win over just them calling your bluff...
The ada website explains all of this
Even then it's difficult because they must not have undue burden. The OP never said he asked for other reasonable accommodation for his business.
Also must understand that in order for that to work, the business must also not make any other accommodations, i.e., curbside service, home delivery, etc....
Essentially, under the ADA, if you have a legitimate medical condition recognized by the ADA, the business is in violation when it flat out refuses you service and offers no other avenue to accommodate your condition.
Go fuck your butt with your "playing the game". Spoken like a true cuck. "Playing the game" means tacitly agreeing to their logic and nullifies your ability to refuse any further tyranny. Grow a set of balls faggot!
Businesses refuse the right to serve customers just like the Christian Bakery situation.
yea but that had a religious reason. a different situation.
no lol don't reach.
im not reaching, they didnt bake the cake because they were christians and it was against their religion. so it would be violating their constitutional rights if they were forced to bake it. thats why they won. if that wasnt the case they would have lost and been hit with fines for discrimination.
no, stop reaching bro,
🤔
private biusiness can refuse service, no shirts no shoes no mask no service
Can a business refuse to serve someone in a BLM t-shirt? If they did, what would happen?
yes and then their business would be burnt to the ground. Dont you love the double standard and all that white privilege?
they would be sued for discrimination
Fuck your private company argument, they don't own me. Literally all industry and business is private, THAT'S WHY WE HAVE LAWS TO REGULATE THEM.
What specific law are you proposing?
Its not 'My' argument. Thats the way it is.
Ok so maybe qualify your statement to say so instead of the deadpan deliver you chose? Context matters, I might have responded differently had you done so.
Also note I said fuck your 'argument' instead of something like 'fuck you'. I vehemently disagree with you and honestly am not interested in debating when your default is 'muh private company' and that horse has been beaten to death already...but that doesn't mean YOU as a person are bad; you've been quite mature in fact, more than me for sure, I'm just concluded on things like this.
Have a great night. And Vote Trump Nov 3 🇺🇸
How bout a class action against that little phoney fk Fauci?
Look into convenience stores being “public accommodations”. Their store policies do not override civil rights laws.
Also watch Peggy Hall’s videos.
There are no "civil rights" associated with wearing a mask.
And don't waste your time trying to invent one. The list of protected classes under civil rights laws is limited.
uh, wrong
OK, genius. Tell me the list of current protected classes under the various civil rights laws in the US.
I'll wait.
Or are you just going to downvote me again and run away like a fucking coward?
https://www.legalmatch.com/law-library/article/protected-classes-under-anti-discrimination-laws.html dont forget our constitutional rights either. pretty sure theres a case here somewhere. ill talk to a lawsuit lawyer.
edit: i downvoted you again... just because
At least you know how to do a search on the 'Net. Now, tell me which of those protected classes applies to masks?
Be specific, and show your work.
And which Constitutional right applies to masks? I'll give you a hint: public health orders have already been upheld by SCOTUS as a power reserved to the states.
Also, let us know how long it took a lawyer to stop laughing before he hung up on you.
You downvoted me because you are a passive aggressive ass, not "just because".
They are a private business they can refuse anyone they want to... don't be stupid
Since when are we the party of "make people do what the fuck we want them to do"... I thought we were supposed to be the party of private property rights....
So if somewhere doesn't allow you in without a mask, then don't fucking go to that place... it's pretty simple... 7-11's aren't a birth right.....
The Democrats are the ones that seem to think they can force everyone to bend to their will even on private property....
What if every place in your town has a mask policy? What if there are no other places to go to? What if the free market can't solve the problem of govt overreach?
Is every place in that town requiring a mask because the local government is telling them they must or are they deciding on their own to implement a mask policy?
Hypothetically, let's just say there is no "law" mandating it, but every business is just implementing and enforcing a mask policy "just to be safe". Most businesses are corporations now, there are no more "mom and pops" (at least where I live).
If I stopped going to places that require masks, I would have to live off of Instacart and Doordash. Is that any better?
What percentage of the people in this town feel strongly about not wearing masks? 0.1%? 10%? 50%?
Hard to say. Most people just put the muzzle on and go about their business. Me included.
Well, this town is hypothetical...
If 1 in a 1,000 people feel strongly, then they are forcing values on the 999 who want masks. If 10% feel strongly, then there is an exploitable market for a startup.
It's easy, if you're on my property do what the fuck I say, get the fuck out or enjoy the new holes in your chest cavity.
This happened to me too. I walked in convenient store maskless, grabbed my items, went to counter to pay. Clerk says can’t check me out since I’m not wearing my mask. I didn’t say a word and grabbed collar of my tshirt and slowly pulled it up over my mouth and nose. Cashier’s face was priceless. He looks over at his manager. Manager shrugs and says check me out. Cashier checks me out I grab my items pulled my shirt collar back down and walked out. It felt great not gonna lie. Next time I’m gonna open my drink and take few swallows before I get to counter. This way when he says he can’t serve me I’m gonna thank him for free drink. 🤣
winning! yea ive had a few encounters so far cause i havnt worn a mask yet and dont plan to. but today was the first time they ever straight up denied me service.
Give em hell pede
You're not helping your cause when you do this.
yea i know but ive just had it with this horse shit.
i dunno, if a dumbass can spill hot coffee on her cooter and slap mcDs with mill dollar lawsuit then i think its doable
