Here we go with the fucking En Banc bullshit again.
Has anyone done a study recently on the difference between the time it takes for a lawsuit that involves the Government as a defendant to be resolved nowadays as opposed to, say, 50+ years ago? My bet is that, just as with the recent increase in Universal/Nationwide Injuctions, the time it takes for a lawsuit to play itself out in the modern era, especially post-2016, is orders of magnitude greater than in decades past.
If my hunch is correct, then the courts appear willing to destroy the very notion of precedent when they, as seems to be the case, force each and every lawsuit against the Government/Trump to go through all the legal hoops before they're eventually tossed out - no matter how similar they may be to ones that went all the way to the Supreme Court just a few years ago - all in the name of resisting the Orange Man.
