I don't see the WHCA named anywhere in the constitution though. And if they were, they would be a part of the government and their exclusion of certain parties would be a similar violation.

I'm sure it depends on how the rulings are worded (though it may be possible to push back about some of that somewhat). However, my point is not to come up with a perfect solution but to suggest that if the WHCA is problematic, it should be possible to bypass it. Probably the simplest solution would be first come, first served. Another might be to recognize a different group as having the authority to decide. If the WHCA doesn't have legally defined authority (and they shouldn't if they do), there are always other options which could be adopted.
