He didn't mention it in this article, but earlier he lamented the difficulty of getting an indictment or conviction from a DC jury (which is where this would be prosecuted). It has to be an airtight case, and even then it's questionable.
Long ago, an investigation into Hillary Clinton's shenanigans with a bogus land development found clear evidence of a crime and even drafted an indictment. But, the prosecution concluded they had only a 10% chance of a conviction with a DC jury. They considered the most likely outcome to be a hung jury. So, they decided to to drop it.
