Pretty clear from the videos that he was attempting to retreat and was forced to fire while retreating. Both of the people he killed were trying to fight his weapon away from him when they exited this earth.

WI law is clear on this issue. Kyle was in legal possession. Justified use of lethal force is reasonable fear of death or severe bodily injury.
