The problem is thus if it's a split 4-4 ruling the lower court decision stands... Given that there will be many lower court decisions on a myriad of issues it's going to be a level of chaos never seen in this nation..
What I am saying is there would be no resolution for a 4 4 split.. It would leave multiple lower courts having mixed precedence...Besides I don't think Roberts is as compromised as many claim..Yes he has ruled against some of Trump's EO, he has also ruled others as lawful, hell even Gorsuch went against Trump..
I don't see him allowing precedence for mass voter harvesting and mail in voter fraud..There is also a decent chance for Trump to get a new judge appointed..It would be a razor thin margin but doable..
The only cases I care about are the inevitable ones democrats start up over the election results a la 2000. All the other cases can wait or go 4-4 and be reheard with a full SC later.
There will be many over the election that's what I am saying..There will inevitably be massive voter fraud, tossed ballots, vote harvesting, late ballots, lost ballots, destroyed ballots, etc.. All of these will inevitably have cases brought into the courts and there will likely be a fair bit will be ruled on by liberal and some will be seen by conservative..We will have conflicting judgements all effecting the election..
Roberts isn't the most dependable, but he has ruled favorably towards Trump on some very hot issues.. I don't see him setting precedence for allowing obvious voter fraud, abuse, and harvesting..
This is a moment where our republic will either continue or truly fall..If the Dems are allowed to sway an election after rampant obvious abuse it's over.
