The SCOTUS still has to make decisions with only 8 people right?

So if there is some election night scamming by the Dems, there is one less vote from the Left...

I didn't like her votes much but RBG was a trooper and I wish her family, friends and relatives nothing but sincere condolences. Shame she was bugged to stay and died without having a nice retirement.

4-4 is not an acceptable outcome, he would need a 5-4 vote to settle the law. He can't afford a bunch of 4-4 ties that upholds lower court decisions, that would create chaos with conflicting court orders. This makes it MORE LIKELY, he will vote 5-3 with the Conservatives. JMHO.

Irrelevant. The issue will be one of state voting laws which is a state issue. Go back and review the way Bush v Gore went.

No problem. Normally state court systems are entirely parallel to the federal system and the federal courts have no say in state affairs. However, SCOTUS has direct jurisdiction over state Supreme Court decisions when “federal issues” are involved.

In 2000 there was great controversy when SCOTUS took up the case at all because so many (leftist) pundits said it was not a federal issue. But if the constitutionality of voting procedures for the President of the United States is not a federal issue, what is?

I agree. We can't complain when they mock Hermann Cain's death, then immediately mock RBG.

We can take the high road and look like the better people, even if we don't really mean it.

That said, while she stood for everything I'm against, she fought for what she believed in and fought like hell. My sympathy for her family.

There's some important dates in the Constitution and law about the election. The Electoral College meets on December 12, and must cast it's vote on December 16th. All conflicts must be resolved by the 16th. If a conflict is not resolved, then that state loses all Electoral votes.

That is really interesting Pede. I have/had a theory that the Dem states would drag out the mail in voting count until after Jan 20th, Inauguration Day. Since no President would have officially elected the Speaker of House would act as President until the vote finalizes.

As an example: Nov 3rd to Jan 20th is only 73 days. The New York Dem primary's took 6 weeks to finalize. But your comment would make that scenario impossible. Good to know.

So....if a blue state cannot resolves it's ballot conflicts by the 16th, then said blue state forfeits it's electoral votes? And therefore cannot help decide the rlection?

Sounds like mail-in voting might not be a good idea for them after all...If there continue to be challenges.

Yes, Roberts can't afford a bunch of TIES which would uphold lower court opinions, and if you had 10-20 decisions and 10 went one way and 10 the other that would be a bunch of chaos if he were to vote against Trump via 4-4 decisions, so my thinking is he would be forced to go with the Conservatives in order to not have chaos.

Even if Roberts, now more unlikely, decides to vote with the Dems voting fraud is off the table.

The supreme court can now require a deadline. Roberts will vote for it.

He is going to now deal with the WH. Retire in a year after Trump is elected and with respect. His other option is to see himself in jail and tarnished.
