I’m an attorney and I’d like to shed some light on why Roe v Wade should be overturned:
Roe’s time has come and gone. The decision was a product of its time - and is not relevant to today’s society. What do I mean? Many do not realize that In the early 70s, contraception was not widely available. In fact, it was banned by many states - while more “liberal” states required prescriptions for condoms. So getting pregnant was much easier - which resulted in a rush of illegal abortions.
Since the early 70s, there has been a complete overhaul of contraceptive health - with condoms/pills/etc being readily available OTC or online. As a result, unwanted pregnancies are more the result of being irresponsible and reckless than being a “victim” of society. You have no one to blame but yourself for getting pregnant.
Roe is treated like the word of God. Except it was based on 70s medicine, and has not been updated or overhauled with more modern medicine knowledge. In the 70s, a fetus May have been a “clump of cells” that couldn’t be saved prematurely. Today it can be. Therefore, abortions beyond day X of pregnancy should be illegal and considered murder. But they aren’t. In fact, some states are legalizing abortion up through the day of birth. Roe is at odds with modern science - but is used to push a sadistic agenda of late term baby killing.
The viability of the fetus was never the main thrust of Roe. The decision was formed by an activist court, and based on a “woman’s right to privacy.” Essentially, no law could stop a woman from having a medical procedure performed as that was a matter between her and her doctor. Ignoring the issue of the fetus in a discussion about abortion proves that Roe completely punted on the topic. It never addressed the real issue - and invented a right in the process.
Roe contradicts areas of criminal law. If you were to kill a pregnant woman, many jurisdictions would charge you with double homicide. This creates a legal paradox: how can you be guilty of murdering a woman’s fetus, but she herself can not be? If she choose to terminate, the fetus isn’t a life, but if you cause it’s death it is a life?
All of these items tell me that Roe is highly deficient and poorly constructed. It is ripe for overhaul - and potential overturning. This is why it is essential to have a third SC pick.
Great information... praying that the overturning may actually come to pass in my lifetime and millions might be saved. Abortion is far worse than slavery (although both are travesties) - and has been a dark piece of American history.
