The Senate has to vote on the SCOTUS for a reason, and it’s to provide checks and balances. If Obama had done a better job the Senate would have been Democratic and he would have been able to push through his nominee.

Hypocrisy? The Democrats changed the game in 2013 under Harry Reid. I remember when Bill Frist floated the nuclear option way back in 2003 or 2004 and the Left went nuts. They changed the rules, constantly shit on our history/traditions but now want to invoke some rule that is not actually a law? Gentleman's agreements only exist if both sides are Gentlemen.

President Trump has a duty to nominate a Supreme Court Justice. The Senate has a duty to vote on those nominees. As President Obama once said, "elections have consequences."

As mentioned below, the logic behind the rule is that the people vote specifically because of the supreme court. If there is a mismatch between president and senate in terms of not knowing what the political desire of the majority is, then you wait for the next election to see.

Eg. If the senate had flipped to democrats in 2018, you would wait to see if trump was rejected in 2020 by the voters too. But the republicans kept control of the senate, so there is no conflict.

Similarly, in the previous case, it was a democrat president but the senate had flipped to republican. So they waited to see the results in 2016. The people rejected the democrats.

I would like to see them ratify new amendments that puts in term limits for senators and congress, as well as upper bound age limits for all elected federal government roles. If you were to turn 80 or above while in office, you do not qualify

But those are the rules and this how the game is played.

Did Obama wait to nominate someone after Scalia died? No. And I don’t think he should have waited. If they had a Dem senate at the time I wouldn’t have blamed them at all for getting someone in the seat. But America didn’t like the direction he was taking us in and in 2014, 2016 and 2018 the Senate has been a Republican majority.

If America doesn’t like how their states are being run then they can vote the other way and power will shift back. Our system isn’t perfection but it’s pretty damn good and kind of a beautiful thing to watch, even when it’s not in the favor I’d like to see it go.

They like to ignore that when Mitch McConnell said we should wait to select a new supreme court justice under Obama we were near the end of Obama's second term. There was going to be a "new" president either way when Obama's time was up.

Biden's OWN proposal put forth that Justices shouldn't be nominated when the President and Senate aren't politically aligned. Per his own beliefs, we'd need to nominate someone right now. (Seems like being a career politician has fucked him yet again.)

Then you have issues like if it's a contested election and we risk a 4-4 vote. (Which has happened fairly recently - Bush v. Gore - and can very likely happen again given how Michigan and Pennsylvania Democrats are actively trying to steal their votes with their bullshit counting rulings.)

You also have Ginsburg's own comments regarding Garland and her saying "The President is President for four years", meaning Trump still has the complete right - even in her own view - to nominate.

Trump and Obama's situations are also different as Obama was on his last term and without question we'd have a new president while Trump is only finishing his first term.

And, what I find especially most delicious of all of this, the Democrats have already decided that ceremony, mutual respect, and tradition went out the door LONG AGO when they politicized impeachment proceedings (because "orange man bad") trying to sway midterm elections. They have NEVER - not once - granted any form of respect or kindness to our side (from the very clearly partisan impeachment to the Kavanaugh debacle, both being utter lows for our nation). So fuck 'em. What goes around comes around. I want him to select a justice that will make Thomas look liberal and I want that justice on their for decades.

I might get downvoted here but I think this is the time for Republicans/conservatives to extend an olive branch to the left. Tell them, "you're right, we will hold off on the pick" and make them always remember that we are the ones with principles. If the American people choose to give the senate to the opposite party from the President, then the American people are choosing not to let that President fill a seat in an election year. The senate thus acting as a check on the President. If the American people choose to give the senate to the same party as the President, then the American people are granting that President their permission to fill seats right up to the day he leaves office.

It doesnt make them hypocrites. They are functioning within their constitutional authority. Thats the whole purpose of Senate affirmation (checks & balances in a multi party (2 party) democracy), otherwise it would just be a rubber stamp approval.

Cocaine Mitch didn't have to confirm anything because Republicans ran the senate. Obama was a Democrat. Biden rule is for when a different party runs the Senate to justify stopping THE OTHER PARTY from getting a pick near a lame duck election.

There's no logical reason to stop the appointment pick of OUR GUY. There's no precedent for that because it would be fucking suicide politically.

Its not really hypocrisy at all. Senate has complete authority to not affirm the President's nomination if it feels so. This is the power provided to the Senate by the Constitution. When the President and Senate are from opposing parties, there is no compulsion on the Senate to do so.

Now WH and Senate are the same parties.

There's two facts they left out. One, not only did we have an election in 2016, nomination of SCOTUS justices was a key campaign issue. It was one of the primary issues that got people out to vote. WE VOTED! Now we need our votes to count!

Two, Ginsburg made her choices, not just personally, but as a SCOTUS judge. Those decisions should be just as final and consequential as any other decision she made as a justice. She could have retired during Obama's term to ensure that the Democrats got to nominate her replacement. We don't know why she did that. Maybe she was making deals with the Clintons, and rested on the assurance that Hillary was going to win. Who knows. She made a decision to extend her term into Trump's presidency. Then she decided to hold on to her position well beyond reason for her age and health clearly trying to out last Trump's presidency. She voted on key issues that should have been made by a Trump replacement. Now, she didn't make it. Voters have had to put up with her unconstitutional rulings for four more years. Enough is enough. She's dead, and Trump is our president. Every Republican in the House and Senate need to pull every favor, use every leverage, make every threat, to get every vote needed to get this job done. We need to throw out every Republican in the House or Senate if they don't get this done by the end of Trump's term.
