The guy you're replying to is correct. Republican Senate leaders declared that because Scalia's seat had become vacant during an election year, the Senate would not even consider a nomination from the president.

No, the Senate didnt consider it because the Senate and the WH were not the same parties. The Senate specifically mentioned it was under no compulsion to approve a Justice nominated by a sitting lame duck president.

Now the Senate and WH are the same parties.
