While I do 100% agree with you in that he should appoint a new Judge, it is definitely hypocritical. Republican Senate leaders declared that because Scalia's seat had become vacant during an election year, the Senate would not even consider a nomination from the president.
If anything, that makes this so much more juicy. I can't wait to see their reaction!
That definitely wasnt the conclusion the Senate came to back in 2016. You are just misleading people. The Senate was under no compulsion to approve Obama's nomination, because they werent from the same party. If it was a democrat Senate you could have bet they would have pushed it through.
How am I misleading? I'm 100% for Trump picking a judge for the vacant seat, I was just letting you know that the guy you were replying to was, in fact, right.
Also, I'm absolutely not implying that Trump is a hypocrite, just the republican senators who said they would not consider a nomination during an election year.
The rationale being they are 2 different parties back then. The Senate is well within its right to not affirm Obama's choice.
Now both the WH and Senate are the same parties.
It doesnt make them hypocrites. They are functioning within their constitutional authority. Thats the whole purpose of Senate affirmation (checks & balances in a multi party (2 party) democracy), otherwise it would just be a rubber stamp approval.
I know. People keep derailing the discussion. I was just letting you know that the guy was right, in that the republican senators who said they would never appoint a SCJ during an election year were technically hypocrites (per definition). And there's nothing wrong with that, what's best for the America comes first!
Cocaine Mitch didn't have to confirm anything because Republicans ran the senate. Obama was a Democrat. Biden rule is for when a different party runs the Senate to justify stopping THE OTHER PARTY from getting a pick near a lame duck election.
There's no logical reason to stop the appointment pick of OUR GUY. There's no precedent for that because it would be fucking suicide politically.
Dude, I'm agreeing with you, he should pick it. I was just letting you know that the guy you replied to was correct. Multiple republican senators claimed they wouldn't consider a replacement during an election year.
