A "dying wish" means absolutely nothing when it comes to the consitution. We cannot just disregard the Constitution all cause someone's dying wish was to do so.

Also, if the roles were reversed, the Dems had the WH and Senate and a conservative judge died or retired, you know damn straight they'd nominate and confirm a justice ASAP.
