I don't disagree with that, but have you heard about how ACB ruled in favor of IL governor Pritzger allowing BLM protests and keeping churches closed? When the church really needed her, she turned her back on it and went for that virtue signal instead. I've also heard she's pretty lax on immigration. Last thing we need is another Roberts.

That decision highlights the problem and naivete we're facing as conservatives trying to counter the leftist agenda.

On the surface, it seems fair to allow local government leeway in deciding its own measures and regulations. But when leftists are involved, what happens every single time is that leeway is then used to restrict the "leeway" of its citizens. Essentially, if you give the leftists a long leash, they end up wrapping that leash around the necks of their citizenry.

This is why limiting local government action IS NOT a restriction of freedom. Rather it is a guarantee of freedom for the citizens.

I honestly don't know why these "smart" judges haven't figured this out.

Unfortunately legal decisions dont always go the way you want them too. Sometimes we are wrong. Sometimes the justice is wrong. Sometimes the law is written wrong and the judges hands are tied.

Judges interpret law not write them. We wouldn't want someone who just decides what a law says based on the outcome they want.

Totally get your sentiment, but the Cuban woman seems to be the better choice of the two. Cubans tend to hate Communism in all of its forms. Also, if she gets attacked, this will turn the Hispanic and female communities against Democrats for generations as well as in the general election.

Key points (from a related article) excerpts

the judges emphasized the governor also still has the authority under the Constitution and the law to impose public health restrictions on religious practices. They pointed to a decision the Seventh Circuit delivered earlier this year, which stated the court believes Pritzker and other governors have no obligation to exempt religious gatherings from COVID-19 prevention measures imposed on businesses and other organizations and assemblies.

However, they said the governor was also free to give religious gatherings greater leeway, compared to other otherwise First Amendment-protected activities, because of the special “speech-plus” status the First Amendment grants to religious exercise and practice.

The primary argument of the court is that the scope of first amendment privileges is 1) limited and 2) administered at the discretion of the governor. And THEN 3) that the plaintiff has to prove unequal discrimination.

On Points 1 and 2 alone , that disqualifies her in my opinion. she agrees with this opinion written by the court, and in essence not only says covid lock downs are OK, but that 1A is, in fact, limited in scope, and is exercised at the permission and discretion of the governor.

It was “favorable” because she said the felon had a right to have a gun because he wasn’t demonstrated to be sufficiently dangerous. Her opinion then went on to describe the conditions under which the government can confiscate guns, and it’s basically a blue print for green lighting such a ruling from her. So no, I don’t think is he’s pro 2A - I think she tolerates the 2A.
