The US Constitution doesn't protect newspapers from being legally accountable for the lies they tell - it just allows them to say them in the first place. If the founding fathers knew how twisted the court system would have become, they would never have allowed any judges and we would have a 12,000 page Constitution with explicit instructions and death penalties for people that tried to twist it.
