1 attacked first, and tried to take his gun. 3 drew on him despite seeing he had no lethal intent, and admitted intending to murder him.
2 could have got the siutation confused in the melee, or may just have been itching to kill a 'fash'. It's hard to tell.
Kyle was still completely in the right to shoot him in defence though. 2 had assaulted him and tried disarming him as a mob closed in. He left him no choice.
