It's not about "How close is it to the election"

It's about who controls the senate.

Obama never got his SCOTUS pick because the senate refused to confirm it.

It's their right to do so.

However, it's important to note that Obama was never denied (or threatened with impeachment) from selecting his recommended pick for the senate to vote on.

Trump gets to nominate someone.

Period

Whether or not that person gets confirmed is up to the senate.

This is the real answer that so many overlook. The Senate as part of Congress is a separate and coequal branch of the government. They are not required to do what the President says, and they are not required to not do what the President says. They can do whatever the hell they want within the confines of their Constitutional authority and the President, any President, can't tell them shit. The President puts forth a nominee and his role stops right there. From that point the Senate can do what it wants with that. Hold hearings, or not. Vote, or not. Confirm, or not. It just so happened to be that when Hussein was in power, the Republicans controlled the Senate and didn't want to do what Hussein wanted, as was their right. Now that Trump is President, the Senate does want to confirm his nominee, as is also their right. This would be just as true if Hillary had won and the Democrats controlled the Senate now.

The Left keeps jerking around about "what about in __ year when this happened, you have to do the same!" and some on the right throw back "well no, because what about in this other ___ year, that's the previous standard"

It's all missing the point. The standard is the Senate does what it wants, and what it wants is based on which party is in charge. That's it. That's the standard. Sometimes it will mean they want to do what the President also wants, sometimes it will mean the opposite.

The Constitution and other contemporary writings undeniably prove that Congress was designed to be supreme over the executive and judiciary. One thing that no one mentions is, at the time Obama nominated Garland, Obama was a lame duck. He was not on the ballot in the upcoming election. For that reason there is a much stronger case for delaying the confirmation hearings.

If the senate was Dem controlled in 2016, then Obama's appointment would have been confirmed, but they weren't in control and that is why. No other reason than the senate can vote yay or nay as they please

Not voting for a 2nd RBG to replace Scalia in 2016 as a Republican Senate is a legislative check on the executive branch. Very simple.

The whole argument was that the American people picked a Republican congress in 2014 even though they had picked a D president in 2012. Since both branches were in control by different parties and the D president was on his way out, it doesn't even apply to now.

Dems will beg you to play by the rules, then ignore them entirely when it is their shot. Look at the riots for a perfect example.

Last I checked, the Constitution doesn't care about leftist's feelings, nor Ruth Bader Ginsberg's so-called "dying wish". Nowhere in that document are either of these two phrases.

The President gets to make his nomination, the Senate gets to vote on confirmation, and there is no filibuster (thanks Obama and Reid!).
