I worked at a pizza place in college (not dominos, a real pizza and beer joint), and a delivery driver rolled forward from a complete stop at a light, into the car in front of them. The couple in the other car filed a $12k lawsuit after they found out he was at work during the incident, for bruises. The insurance company threw them a grand to go away. Happens all the time. It's not about "proving' anything, it's finding out how much the insurance will pay you to go away.
And, there are PLENTY of scummy lawyers who have no problems filing claims like that. For a bottom feeder lawyer, that's most of the clientele.
Never underestimate the power of a sleepy attorney. I know someone who was in a similar accident and have to deal with the mess of an attorney claiming the pain and suffering bull crap from them simply going to the hospital to get checked out And found to have zero injuries as a result.
