I agree that the first one will be the most difficult to defend, but, from the view of a defense attorney, I believe it is entirely justified given the totality to the circumstances. You do not need to run for your life and continue to run and wait to be attacked before firing in defense when gun fire is going off. The gunshot from the POS is key.
