So if an officer fires at a suspect and misses and hits someone else even if his line of sight isn't perfectly clear they will not normally be charged. There has been no information on the state of mind, line of sight of the officer, or what caused him to fire. All the information I have seen says he is simply being charged because his bullets ended up in neighboring apartments. Charging officers for where their bullets ended up, especially if no one was hit sets a very dangerous precedent.
Furthermore, the statute Hankinson is being charged under 508.060 - Wanton endangerment in the first degree.

Wanton disregard requires willfulness. Can it be willful if Hankinson was merely mistaken?
