There is absolutely no way the Supreme Court takes up the confirmation. There is no constitutional mechanism that stops the Supreme Court nomination process. No article III court has authority. This is what is called a non-justiciable issue. Because this power is clearly designated to the senate to advise and consent and there are no prerequisites for how this process happens AND because the constitution doesn't give Article III courts (all federal courts) authority over this they legally cannot even decide the issue and wouldn't hear the case.

The responsibilities of the President do not end until the term is over, election or not. It is within the law to confirm the justice, whether or not the democrats like it. MAGA & KAG TRUMP/PENCE 2020

Unfortunately for the Dems, early voting is not enshrined in the Constitution.

The Congress may determine the Time of choosing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

A challenge to the appointment will result in a ruling that early voting is illegal. The left will never put early voting, a vehicle for voter fraud, at risk.
