Somewhere there has to be a statute which limits punishment or conditions of a court decision to that in the realm of reality. Demanding one submits to a vaccine which does not yet exist is a bit like demanding the defendant grow wings and fly to the top of Mt. Everest.

Whether one can be compelled to submit to a vaccination at all is another matter yet to be decided.
