I am a republican and I did not know this until now. Normally we become informed when a government worker does wrong. That no longer happens.

The ironic part, is we aren't "tribal" enough. We like to remain free and private people. To fight this shit, we need to pretty much form an equal but opposing force. We have to have our own narratives and agendas, just for survival. Becoming what we hate. "Democracy" and mob rule is stripping down the individual and their freedoms. We can form united fronts, but we are going to end up being less private to be more involved in our communities as it were. Which I am fine with, but you have to convince others to use their freedoms to act in a manor that also preserves that freedom. This is the tricky part, but I can see some of the makings here, so there is hope.

The gun was used as an example prop in court by the wife, who is also a criminal defense attorney. To enter the court building, is has to be rendered safe and not able to fire. They never set it back to be able to fire, presumably either out of either need to use it again later, or just not bothering too since they had at least 1 other gun and she is clearly not well trained to use it.

The DA ordered it to be disassembled and examined to see if it could fire (which it couldn't at the time), then ordered is reassembled in firing configuration to be able to claim it was capable of being used at the time. Because it COULD be reassembled in a way to work with no extra parts, the DA is basically now claiming it WAS ready to use. It's like if I had a car with a bad starter because the ground strap wasn't attached, then the DA ordered it repaired while accusing me of driving recklessly. The DA then charges me with tampering with evidence because the car that wouldn't run at the time of the supposed crime "was clearly repairable with no extra parts!"

If i were the DA, I would argue that they knew she brandished the weapon when she flagged the trespassers with her finger on the trigger and subsequently removed the firing pin to negate the charge... but that's a hell of a thing to prove after the fact

The police were asked to and refused. One of the DAs assistants actually reassembled it. Was my understanding when this came to light. Additional details may have emerged. I haven’t kept up with it.

They are apparently claiming that the McCloskey's "tampered" with that pistol by reversing the firing pin, making it inoperable so they could use it as a court prop. The prosecution then asked the police to fix this so they could charge them with two firearm violations. The police refused, so the DA had some private gunsmith fix the gun.

When this went down, I predicted they would pull the firing pins before handing the guns to their lawyer. They did something similar, they disabled the firing pin by putting the spring in the wrong place.

The corrupt DA and forensic detective goons took it apart, assembled it in working order, and then lied about it. And they're going to get their asses sued.

Guarantee he documented (probably video), himself disassembling it to show that the spring was forward of the pin instead of behind. Or at least he recorded himself demonstrating that the pistol was disabled, by cocking it and pulling the trigger with no click.

Don't get me wrong though. I don't believe for a second that pistol was not in working order when the lynch mob broke on to their property.

What we believe should have no bearing on the legality of it. An interesting case is RA from Michigan where she was a prohibited possessor who pulled a nonworking (unloaded i believe) firearm on a person robbing her. It had to get appealed but she won her case as they ruled it wasnt a lethal tool, which made brandishing it different than if it were functioning.

Actually the handgun had been intentionally disabled by the McCloskey's because it had been used in a previous case as a prop in court. That's why the wife was swinging it around with her finger on the trigger (even though she still shouldn't have): it wasn't capable of firing.

So they DA must be claiming they made this change just before handing the gun over instead of when they said they did it. I would assume what the McCloskey's said could be easily verified by the court where it was used as a prop.

The entire reason behind this charge is because the DA got caught red-handed by her own crime lab, tampering with the gun and re-assembling it as a functioning firearm, despite it not being confiscated in that condition.

She's attempting to muddy the water to distract people from her own unethical, and possibly criminal, act.
