Brandishing is a bullshit charge in the first place. Since when is it reasonable to punish people for not shooting someone? "Oh noes, it wuz scawy." Go to hell! First of all, that's the whole goddamn point of a threat display (which is an attempt to avoid violence, and in this case was clearly effective), and second, the Constitution wasn't established to protect our fucking feelings. What's next, arresting people because their dogs barked at a burglar?

I don't know Missouri law, but in my state it is expressly legal to display a weapon, with the intent to use it if necessary. In fact, the law sets a lower threshold for threatening use of a weapon than actually using it. Displaying a weapon is considered "force". Firing a weapon is considered "deadly force".

In my state, use of force (but not deadly force) is legal if you *reasonably believe the force is immediately necessary to prevent or terminate the other's trespass on the land".

Fire a warning shot? No, because depending on the circumstances, that could be considered felony "deadly conduct".

According to what has been reported, the McCloskeys would have been well within the boundaries of the law in my state, since the others were clearly trespassing.

But, I don't know the reason for the charge of "tampering with evidence". The handgun she held was inoperable, as the firing pin has been put in backwards. The crime lab documented that they found it that way, and reassembled it correctly. The McCloskey's attorney said that was intentional, as they used the gun as a prop in a court case, and had to disable it. Perhaps the DA is trying to force them to prove it in court?

If the penalties for 'shout', 'show', and 'shoot' are the same, you might as well shoot.

If my own elderly and disabled mother (who warned the evil doers would be coming after her and/or my sister, to get to me, in the weeks after G.Floyd riots); and 3 weeks her prescience, in Mid-June over a dozen armed officers came to do an anonymous "senior welfare check", threatened to breakdown the door, and arrest us, without warrants. They kidnapped her from her property, held her for 17 days, tortured her, starved her, thirsted her, violated dozens of laws/rights, she looked like a Holocaust survivor when they finally let her leave.

If my mom can still hold restraint against these evil forces, and put up with being tortured, than you can too. As she said, for 3 weeks prior to her kidnapping/abduction; DO NOT LET THEM FORCE YOUR ACTIONS, that is what they are trying to do. They even had one officer who's whole job was to stand in the neighbors front yard with a video camera and record the whole thing, them trying to be like CNN at Roger Stone's house.

If you use violence, you're just injuring random "following orders" types, who maybe have nothing to do with anything (like our Patriots whom volunteer after say 9/11 get sent halfway around the world to be ground up; it solves two problems for the evil doers--you and the random patriot ordered to go knocking on your door get put into a situation that can end badly.)

So after a half century, she finally authorized evacuation, after she votes. This is on top of the Commies cutting the water off for 21 months now (yes to all those around the world, this is a sub-urban house worth over Half-mil, without running water in the USA, home for over 50 years, bc the commies and corruption is very real). In addition halfway across the country, Grandma has been kidnapped/abducted unlawfully since last Oct. Now how many people do you know who will hold-the-line like this?

The FIB is supposed to be the ones to investigate these local corruptions, but the local office is too much on a first name basis with the local agencies doing the evil.

Even the local media stations wouldn't even cover it at all.

Totally a coincidence if after bringing attention to corruption, unconstitutional issues, fighting the Marxists & swamp, that powers of gov like: Child Protective Services, Adult Protective Services, Red-Flags, Medical Holds, or anonymous tips "S.W.A.T.'ing" occur upon you or members of your family... being forcefully removed/arrested, tortured, etc. In addition to damage to your property, vehicles, biz, Name/reputation, files/computers, gov contracts/services, etc.

This is a somber discussion. Yes, we really are at that point. Myself, I live at the end of a dead end street where the angry mob would ignore, until their desperate last measure. I'd hear lots of goings on all around me, and have weeks of notice before it ever got to me. This was deliberate.

The proverbial angry mob outside your house, clearly we're better off firing than brandishing. The trick is to make sure none escape. That's the first thing I was taught as a young child. Anybody that gets away WILL come back, and they'll be more trouble when they do. Coordinating a neighborhood defense so you have triangulation and none escape is in order. If you are a housewife I would urge you to indeed wait until this scenario imposes itself upon you, and hopefully it never will.

I don't intend to watch my fellow Countrymen get picked off one by one like they've done to South Africa while I hide like a coward. I feel like storming Normandy! My Mom's Uncle was the first soldier into battle on D-Day, and lived through all that mess including the battle of Bastogne. And beyond. He came home in one piece. Our domestic enemies are more dangerous than Nazis, because there's no coming home from this for many. Some of us need to be heroes soon. We'll get one night, and we'll swamp LEOs so they can't track down everybody. Military will deploy in the morning at the earliest. We can have a 300:1 ratio.
