Since by definition this would require Pence and a majority of Trump's cabinet to be on board, not sure where Crazy Nancy is going with this.

Right, but Pence isn't going to pull the trigger to remove Trump. What would the point be? He'd be certain to lose the election after trying that stunt.

Pence doesn't strike me as the treasonous type to even contemplate going along with this.

And WHY would he do it? Pence is the natural face to nomination in 2024.

It's not about whether Pence will pull the trigger or not. They are going to try to send this through the Senate, which will delay ACB.

Without Pence, there is no path through the 25th Amendment. The VP has to agree to invoke it, period.

That's not how it works. It requires Pence to start the process before it ever even goes to the Senate.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide...

So it could Pence + a majority of some other group, but Pence still needs to sign off on it. I don't think the silver fox will do it

What is "or of such other body as Congress may by law provide..." referring to?

*I am not a lawyer, so take this response with a grain of salt. I would very much appreciate a lawyerpede telling me if I'm right, or correct me where I'm wrong.

My guess is that it gives congress the ability to pass a law saying another group can take the place of the cabinet in invoking the 25th amendment. I do not know of any restrictions on this group other than congress must vote on it into law.

I do not know of any such law that congress has passed, so it may be no such law exists right now and the only current way to trigger the 25th amendment is to vp + cabinet. But even if such a law has passed, the 25th amendment still requires the vp + the other group.

If it had to take a guess, assuming Pelosi was serious about invoking the 25th amendment and it wasn't just for PR, she is looking into if such a law was previously passed(again still requires vp + this other group), or writing a bill to create such a group that she know will try and trigger the 25h amendment.

Assuming Pelosi is writing a bill, it will have to pass through the republican senate before it can become law.. Even if a bill somehow passes the republican senate, GEOTUS will veto it. Even if SOMEHOW the veto gets overriden, vp would still have to agree with the group to trigger the 25th amendment.

Thank you for your reply. This provides clarification; we'll see what trick she has up her sleeve today.

If Trump can be removed "because COVID," and replaced by Pence... what happens if Pence gets COVID? Now you have a precedent. Remove Pence and BOOM. President Pelosi.

My worry, is that half the republicans are corrupt as fuck as well. Look at Paul Ryan doing fuck all when he was speaker, not to mention Gowdy and ‘Im going to write a really firm letter this time’ Graham.

Anyone with skeletons in their closet has an interest in preventing POTUS from getting a second term.
