It would appear her strategy is to have Trump sign into law his very undoing. Per the 25th Amendment:

"Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office..."

They need Pence, a majority of the Trumpster's cabinet, >2/3rds of the House, and >2/3rds of the Senate. It's more difficult to oust a president via 25A than it is with impeachment, which only requires a simple House majority and >2/3rds Senate.

It's a stupid piece of theater for ignorant people to be distracted by.

It's a multi-step process:

  1. Pence and majority of cabinet (or this "commission") agree Trump is unfit to serve.
  2. Pence becomes Prez.
  3. Unless he is truly incapacitated, Trump declares he is fit to serve.
  4. Within 4 days, Pence and cabinet/commission agree AGAIN.
  5. Within 48 hours, Congress assembles (if not already in session)
  6. Congress has 21 days to decide whether Trump is unfit to serve. This requires a 2/3rd vote of both the House and the Senate.

The Democrats want a somebody other than the Vice President to remove Trump. Their plan is to get Trump to pass the bill that gives them the power to remove Trump.

You are right. Without this law Pence would have to agree.

Ahh right, so the body she's proposing they create would override what's written in the constitution.... and Trump can just say no?

Even with this law, Pence has to agree. You have to parse the 25th Amendment carefully:

(VP and (Cabinet or Congressional commission))

There is no way to bypass Pence, without removing him first.

It gives Congress the power of the 25th amendment to remove a president without impeaching him.

Even with the proposed bill, it is harder to involuntarily remove the President through the 25th Amendment than via impeachment.

That was the intent.

Trump should sign it and call her bluff.

As someone else has pointed out, it requires the cooperation of the VP (Pence).

But there's a "circuit breaker": all Trump has to do is declare himself fit for duty. Unless he is incapacitated, you can be sure he will do so.

Once he does that, Congress has about 3 weeks to hold a vote, and it requires a 2/3rd vote of both the House and the Senate to override him.

The proposed legislation bypasses Pence. Trump can refuse to be examined and still removed. Zero chance this will become law.
