I will start by borrowing Cameltoe's history lesson: when Lincoln had the Senate in 1864 and a seat became available on the Supreme Court, he did not nominate his pick. Not because "it was the right thing to do", but because it was strategic.
Lincoln ran on a unity campaign but he intended to pick a justice that would alienate that unity. So he waited, knowing he had the election in the bag. Then, during the lame duck session after the election, he nominated his pick.
The same could be true here. If Trump is sure he's going to win, why rush? Why not indict O'Biden and HRC the day after the votes are cast? That way, nobody can claim that he's interfering with the election. Instead, he walks into his second term having pulled the drain plug on the swamp.
Thoughts? I couldn't help but see this strategy after thinking about Lincoln in 1864.
