Kyle had the first and second people he shot try to grab his gun from him (an act that makes it very reasonable to believe someone is seeking to kill or cause you great bodily harm) and the third guy had a gun in his hand and lunged toward him.

This guy has a can of pepper spray and is about 7 feet away. Obviously we should never rush to judgment but the differences are as clear as crystal.
