It would be exceedingly difficult to prove a case of legitimate lethal self-defense against open-air mace.
Generally speaking, legitimate self-defense involves reasonable and equitable retaliatory violence. Escalating violence or excessive violence no longer qualifies as legitimate self-defense. Lethal use of force in self-defense requires a legitimate and reasonable expectation of serious harm or death, even in very pro-2A states.
It seems fairly impossible to suggest that open-air mace warrants lethal retaliation in self-defense.
I would assume the only defense would be "i thought it was a gun", but since he was reportedly egging him on and daring him to mace him then presumably he can't even argue that since he had fore-knowledge of what exactly he was reaching for
It appears as if gun guy could have safely fled the scene without drawing his weapon.
Is Colorado stand your ground?
This could get weird if it is. It’s likely murder because they were aggressive and harassing the folks.
That shouldn't matter, I don't think.
