Adding to my original post, this guy was obviously trained and KNEW that mace isn't a deadly weapon. He was in public, had PLENTY of space to remove himself from the situation, and immediately went to " Oh well, guess ill shoot this guy in the head!"

You can see the deceased patriot suddenly becomes less interested and focuses on the shooter. He pulls his mask up, and walks towards the shooter off frame. He says something here too but I can't make it out.
I think right at this moment, the patriot sees the gun in the shooter's hand being drawn or already in the shooters hand and is walking towards it.
We also hear the sound of a round being chambered soon after. Patriot then sprays mace and is shot instantly.
A jury is going to have to be convinced that the action of that man moving forward with a can of pepper spray made the shooter in fear of his life or great bodily harm....thats going to be tough to convince a jury on. This will likely be a second degree murder charge (murder in the heat of passion) and probable conviction.
The thing for me is that if you are armed with a weapon for self defense, a wise thing to have on you also can make for the situation unintentionally more dangerous if escalated.
If the deceased didn't have a weapon like a knife, mace or even a baton and he was approaching the gunman even if they were arguing id sad the shot was completely unjustified.
Now given the same situation and it was like a scene from say portland, with 50 rabid people around you and someone starts to approach you in the middle of a confrontation its much easier to justify since you could be easily disarmed by the crowd during the scuffle even if your gun is concealed
In this situation its all about who drew which weapon first and i suppose how heated the scene around them were. As far as I see there's no full video of the incident start to end or i just missed it.
For me it just needs to be clearer whether the gun was aimed and chambered before the deceased raised and or shot the mace, and whether or not the gunman made any attempt to retreat although i don't know the laws in denver regarding those particulars.
Either way if people can "mostly peacefully protest" over a lot of these police shootings than this easily counts as a reason to be outraged.
