well, to be fair, it is in the first amendment. anyone can in fact be a member of the press. their is no such thing as a "legal press pass" issuing agency. official press passes are given by companies/corporations to identify themselves as employees of said agency. also, private/government functions/agencies may issue press passes to people for entry to property/events, nothing more.
