The thing is I don’t think any responsible gun owner will say a pepper spray can be countered with a lethal force. Clearly the shooter here is not justified in his shooting.
If someone uses pepper spray on an officer, you can bet 100% they are allowed to use lethal force. Same applies with citizen in many states. 1+1 rule. They escalate with pepper spray, they can now disarm you and use your gun against you as the aggressor.
