Juries aren't dumb. That's why they acquit all those cops.

Nah. In Colorado second degree murder only carries a 8-24 year sentence.

Yeah and spending a decade or more in state prison can shorten one's life span considerably. I didn't say he was going to get a life sentence, possible but not probable. He might not make it out however. A big tough guy like him with a video game tattoo, I am sure he will make tons of friends.

That amount of time in a correctional facility at that level can also result in loose anus. Consult your physician if you’re experiencing symptoms of loose anus from being repeatedly raped in the butt by dirty mike and the boys.

I’ve never seen a security guard that looked anything like this. This is not legitimate security.

There is an image of the deceased smacking the shooter before he draws his weapon. This might be self defense.

What if he told the deceased to back up? And then deceased proceeded to mace him. Regardless he should have just ran away.

You get to shot people in the head when they smack you now? Seems excessive to me. Kyle Rittenhouse was being chased, shot at, and they attempted to disarm him while he was surrounded alone at night with no police in sight. He's facing life in prison.

Not to mention the two parties in this case separated after the smack to the face, security guard draws his gun, patriot tells him put it away while holding mace(non lethal), security guard has a chance to escape(duty to retreat) and instead executes the patriot with a head shot. You can see by his eyes that the mace didn't even touch him.

Self defense doesn't work like that in any state except maybe Florida. For sure not Colorado.

Yeah. I realized he should have run away now. He obviously had a choice to retreat and chose to stay and kill him.

Self defense is a very complicated legal situation most of the time. You really can't just gun someone down unless they have a lethal weapon as well. You must use proportional force. Now if the fat patriot was literally on top of the security guard punching his face in then yes deadly force would have been legal.

Generic self defense info:

act reasonably retreat if possible without taking any physical action, and use only the amount of force reasonably necessary to fend off the attacker.

Colorado law is a bit different but it still says you should only use deadly force to defend against deadly force. Colorado however does not have a duty to retreat law. The courts will have to figure it out. I don't think it will work out well for the shooter but I am not a lawyer.

This guy is and has a lot more info than I care to post.

Most states don't have a duty to retreat law (which is good, those things are stupid). But yes you're only allowed to use deadly force when you believe the person poses a significant threat of serious bodily injury or death to yourself or others. So definitely not in this case.

Otherwise every time some jerk pushed someone they could fast draw a pistol and kill them. Which is pretty much what happened here.
